Possible Consequences of a DUI Conviction

DUI is a serious offense with serious consequences. Even as a 1st offense, DUI can result in fines, jail time, license suspension, DUI education (for which you must pay), and public service. As you would expect, if you have a history of DUIs, the penalties will be harsher and include: higher fines, more jail time, more time in community service, longer license suspension or even revocation, and the required use of an ignition interlock device. In Georgia, you are considered to have “implied consent” to have your sobriety established if the police pull you over. This means you are required to take the field sobriety test and, if asked, the chemical tests to determine your blood alcohol content (BAC) to see if it is over the legal limit -- in most cases 0.08 percent. Many people are not aware that If you refuse to submit to testing, your license will automatically be suspended for 1 year unless your attorney files an appeal within 30 days (the 30-Day Rule). Of course this means that it is essential that you hire a competent attorney quickly.

DUI Charges for Substances Other Than Alcohol

In Georgia, DUI charges can be brought against you if your driving is impaired by substances other than alcohol, such as illegal drugs, prescribed medications, or over-the-counter products. This means that if your blood or urine shows the presence of cocaine, heroin, other street drugs, or too much prescribed or over-the-counter anti-anxiety or sleep medication, cough syrup, painkiller, or inhalant, you can be arrested for DUI. If you are in possession of drugs, or if you have taken drugs and alcohol in combination, you may be subject to further charges and more severe penalties.
